“We work with kids from marginalised communities who spend most of the time alone or with their siblings. “We want to build a channel of mentors across the country and use telephone as a tool for change. The mentors speak to the kid over the phone and are expected to meet him/her at least once a month through monthly meet-ups organised by us. Trust building is one important huddle to overcome while exploring their potential and encouraging them to do what they are best at. Manish says, “We firmly believe that there are plenty of people who not only want to give back to society but help shape a new one. One of the effects of the ban and other restrictions in place for nearly a decade and a half in Mumbai is that not only some dancers but their young children too have been pushed into prostitution, which activity the State curiously recognises and tries to regulate as a kind of social safety valve. In sum, dance performances in dignified forms are now socially acceptable and the Supreme Court believes it is time to draw the curtain on restrictions. Things may pan out differently at the ground level as dance bars have to deal with greedy policemen and bureaucrats. The sharp focus of judicial thinking alone could have led to the recognition that such dancing, a part of our history with princely and feudal patrons, should be seen as just another mode of employment.

In large cities with a diverse population, some earn a livelihood from the fringes of the entertainment industry like dance bars. Such acts were probably more vulgar than any dance form that tends to objectify women. The court has noted how changes have emerged in perceptions of morality and it’s now up to Maharashtra to try and make it work rather than hark back on ancient morality.The prohibition on “showering” dancers with money is a significant part of the court’s ruling. The imposition of morality in a blanket manner, particularly when we know of the hypocrisy involved, can destroy livelihoods, as we have seen in the lives of at least 75,000 women and the male staff who help run the bars, imposing some discipline on customers and providing security to the dancers.Many details must be worked out if Mumbai’s famous dance bars are to reopen, but a key principle has been vacuum valve established in the Supreme Court order: that the government cannot impose its notion of morality on society.

The truth is that many destitute women, who may not be fit for any other type of work, were the principal players and they have been out on a limb after the present government added its moralistic stance to the one already taken by its predecessor. The threat to public morality from dance bars, or their equivalent in “orchestra bars”or “cabarets” as they are euphemistically called, is more imagined than real.Social activists have noted that a large part of the dancers’ income went into educating their children.. What is, however, more important is the principle of allowing women dancers to earn their living, provided they do so safely and do not indulge in obscenity. Obscenity is quite routinely shown in our films. However, cinema is one segment where we have now accepted that morality standards have changed over time, and Indian audiences are free to view content that would have been unimaginable in times when the idea of morality was far more rigid

It was said in the judgment that “The King hath no prerogative but that which the law of the land allows him. It’s its sheer boldness that takes one’s breath away. Even so, it is necessary for the court to cast off its legal restraint and examine if there has been any abuse of power. This is the great danger in the unilateral handling of Brexit too.The boldness in standing up to define the powers of governance must be admired. What Boris Johnson did in leading the apolitical monarch into such misadventure was akin to imposing a state of emergency so that his plans could prevail, come what may.The executive, headed by the PM, was being held to account. The judiciary, not known to intervene in political disputes in a country where powers are delicately balanced and bound to an unwritten constitution, has stuck its neck out in ruling that the suspension of Parliament was “unlawful”.

The court said the case wasn’t directly about Brexit, but about a PM’s abuse of power in wrongly advising the Queen to prorogue Parliament for over a month to give elected representatives of the people less time to intervene in his plans for his country, and how he will decide how Brexit would go.” How one wishes this would apply to all arms of society, including the judiciary too. Take India’s Supreme Court, which seems wary of even taking up for legal scrutiny the issue of the abrogation of Article 370 in Jammu and Kashmir. The point to note is that Parliament was not bypassed even in such an extraordinary decision by the executive. This precedent should trigger the belief worldwide that courts should step in, even suo motu, if they feel any of the principal pillars of civil society is getting carried away and arrogating to itself absolute powers. Such an effort to save Britain from a populist leader bent upon going ahead with a “hard” Brexit with reckless abandon should be lauded. The judgment can be interpreted as judicial overreach in the UK, even activism, in a country whose courts have never sat in judgment on politicians and politics
